Empowering Apartment Owners Across Noida & Greater Noida
Understand your statutory rights under the UP Apartment Act 2010 & Model Bye-laws 2011, follow the lawful 8-step AOA formation & handover sequence, and track society RTI & Registrar proceedings.
- 1 Deed of Declaration First (Sec 12, 13): Fixes every apartment's undivided interest % in common areas and voting weight.
- 2 Elections Before Registration (Bye-laws 18, 26): General body adopts Model Bye-laws and elects the 4–10 member Board before registration.
- 3 Mandatory Handover (Sec 4(6), 14(5)): Promoter must transfer common areas, original sanctioned plans, and IFMS to the registered AOA.
What a Properly Formed Association Looks Like — The Lawful 8-Step Sequence
UP Apartment Act 2010 & Model Bye-laws 2011Step-by-step statutory sequence from filing of the Deed of Declaration (Form A) to General Body elections, registration with bye-laws, promoter handover, and annual audit.
Declaration Filed
Promoter files the Deed of Declaration in Form A before the Competent Authority — fixing each apartment’s undivided interest % and voting share. Every owner is entitled to a copy.
33% Trigger Reached
33% of apartments (or the number needed to form an association, whichever is more) have been handed over by sale, transfer, or possession. Duty to register rests on the promoter.
Notice & First Meeting
2 to 7 days’ written notice stating the time, place, and purpose of the first General Body Meeting is sent to every apartment owner, with a copy marked to the Competent Authority.
Bye-Laws Adopted
General body adopts the statutory Model Bye-laws with 30% quorum recorded in numbered minute books. Any change requires the Competent Authority’s prior written approval.
Board Elected First
General body elects 4–10 office bearers (President, Secretary, Treasurer, Members — all apartment owners) voting on percentage basis for a 1-year term prior to registration.
Registered with Bye-Laws
The Association, its adopted bye-laws, and its elected Board are registered together before the Deputy Registrar. A registration certificate without registered bye-laws is of no consequence.
Promoter Hands Over
Physical possession of common areas and facilities, original sanctioned plans & engineering documents, and the Interest-Free Maintenance Security (IFMS) are transferred to the registered AOA.
Annual Cycle Begins
Annual General Meeting in the first quarter, annual elections to all posts, accounts audited by a Chartered Accountant and published by 31 July, with summary sent to every owner within 15 days.
