Plain-Language Summary

Under Section 14(5) of the UP Apartment Act 2010, immediately upon registration of the Association of Apartment Owners (AOA), the promoter must hand over charge of the building, common areas, all original documents, plans, and the balance of the maintenance/sinking funds to the elected Board. However, an AOA should never sign an "unconditional full-and-final satisfaction note" without conducting a rigorous technical, legal, and financial snag audit — taking over operations "under protest / subject to defect rectification and financial audit."

1. Who Does This Guide Apply To?

  • Newly registered AOAs preparing to take over maintenance operations and security from the builder.
  • Technical, Finance, and Legal sub-committees inspecting society infrastructure during transition.
  • Societies already running maintenance that are pursuing pending IFMS/Sinking fund recovery or missing drawings.

2. The 4 Pillars of Statutory Handover

Land Title, OC/CC, DoD & Statutory Clearances

1. Statutory & Legal Records

Original Lease Deed with GNIDA/Noida/YEIDA, all Completion/Occupancy Certificates, registered Deed of Declaration (Form A), Fire Safety NOC (renewable), Pollution Control Board Consent to Operate (CTO) for STP & DG sets, Electrical Inspector approval for HT/LT transformers, and Lift Operating Licenses.

Architectural, Structural & MEP (Mechanical, Electrical, Plumbing) Maps

2. As-Built Engineering Drawings

Complete sets of "As-Built" drawings (both AutoCAD soft copies and signed blueprints): underground water/sewer piping, electrical cabling trenches, earthing pits, fire hydrant & sprinkler loops, basement drainage, rainwater harvesting pits, and structural load plans.

IFMS, Sinking Fund Corpus, Prepaid Meter Balances & Audited Accounts

3. Financial & Fund Transfer

Full transfer of Interest-Free Maintenance Security (IFMS) / Corpus / Sinking Fund with accrued interest; CA-certified flat-wise ledger of maintenance collections and builder-unsold flat dues; prepaid electricity/water meter float balance; and confirmation of zero past electricity/water bill arrears up to handover date.

Equipment Inventory, Warranties, Keys & Active AMC Contracts

4. Physical Assets & Vendor AMCs

Physical verification and joint health-test of all Lifts, DG sets, Transformers, Water Pumps, STP blowers/motors, Boom Barriers, Intercom, CCTV cameras, and Club equipment, along with OEM warranty cards and room keys.

3. Recommended Handover Execution Protocol

1
Serve the 30-Day Statutory Handover Demand Notice Immediately after obtaining the AOA registration certificate, PAN, and bank account, send our standardized Handover Demand Notice to the promoter with a copy to the Competent Authority.
2
Commission a Third-Party Technical Snag & Safety Audit Have qualified engineers or OEM technicians (for lifts, fire systems, STP, and electrical panels) inspect equipment health and prepare a quantified Snag & Defect Report.
3
Take Operational Control "Subject to Defect Rectification & Financial Settlement" Take over billing and vendor control so residents stop paying the builder, while explicitly recording pending financial recoveries and incomplete works in the joint handover memorandum.
